§1 Validity towards entrepreneurs and definitions of terms

(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order. (2) A consumer is any natural person who concludes a legal transaction for purposes that cannot primarily be attributed to their commercial or independent professional activity (§ 13 BGB).

§2 Conclusion of a contract, storage of the contract text

(1) The following regulations regarding the conclusion of the contract apply to orders via our online shop https://www.hookahx.de. Before the order is bindingly sent, the consumer can go back to the website on which the customer's information is recorded by pressing the "Back" button in the Internet browser he is using, after checking his details, and correcting input errors or canceling the ordering process by closing the Internet browser. We confirm receipt of the order immediately by an automatically generated email (confirmation of receipt). This does not constitute acceptance of the offer. Acceptance of the offer takes place in writing, in text form or by sending the ordered goods within one week. §3 Prices, shipping costs, payment, due date

(1) The prices stated include statutory sales tax and other price components. In addition, there are any shipping costs. (2) The consumer has the option of paying in advance, cash on delivery, direct debit, PayPal, credit card (Visa, Mastercard, American Express). (3) If the consumer has chosen to pay in advance, he undertakes to pay the purchase price immediately after conclusion of the contract. If we deliver cash on delivery, the purchase price claim becomes due upon receipt of the goods.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for immediate dispatch. Delivery takes place within 5 working days at the latest. In the case of payment in advance, the deadline for delivery begins on the day after the payment order is sent to the bank responsible for the transfer and, for all other payment methods, on the day after the contract is concluded. If the deadline falls on a Saturday, Sunday or public holiday at the delivery location, the deadline ends on the next working day. (2) The risk of accidental loss and accidental deterioration of the item sold, even in the case of a mail order purchase, only passes to the buyer when the item is handed over to the buyer.

§4a Youth protection and age verification

(1) The sale and shipping of tobacco products, tobacco-containing products, nicotine-containing products as well as e-cigarettes, e-shishas and their accessories takes place exclusively to people who have reached the age of 18. The provisions of the Youth Protection Act (JuSchG) apply, in particular Section 10 JuSchG. (2) During the ordering process, the customer confirms that they are of legal age. We reserve the right not to carry out orders where there is concrete evidence that the purchaser or the actual recipient is underage. (3) Age-restricted goods are delivered exclusively via DHL using the service “Age check from 18” (identification check). The goods will only be handed over personally to the adult purchaser or an adult who is authorized to receive them. The delivery person checks the age using a valid official photo ID (ID card, passport or driving license). In this case, it is not possible to store it in the parcel shop, with a neighbor or at a desired storage location. (4) If the age verification cannot be carried out successfully upon delivery (e.g. recipient is not of legal age, has not been found or does not have a valid identification document), the shipment will be returned to us. The resulting costs for return and re-shipment may be charged to the customer.

§5 Retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

§6 Right of withdrawal of the customer as a consumer

Consequences of revocation If you revoke this contract, we must repay to you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we received notification of your revocation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired. You bear the direct costs of returning the goods. Exclusion of the right of withdrawal for certain products (hygiene items) The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. These include in particular, but not exclusively, shisha bowls (vases/glasses), shishas, ​​and bowls. To accept the return of Shisha products, the goods must be in an unused condition and in the original, undamaged packaging. It must be clearly evident that the products have not been used. Financed deals If you have financed this contract with a loan and you revoke the financed contract, you are no longer bound to the loan contract if both contracts form an economic unit. This is to be assumed in particular if we are also your lender or if your lender uses our cooperation with regard to financing. If we have already received the loan when the revocation or return takes effect, your lender assumes our rights and obligations from the financed contract in relation to you with regard to the legal consequences of the revocation or return. The latter does not apply if the subject of this contract is the acquisition of securities, foreign currencies, derivatives or precious metals.
