§1 Validity towards entrepreneurs and definitions of terms
(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order. (2) A consumer is any natural person who concludes a legal transaction for purposes that cannot primarily be attributed to their commercial or independent professional activity (§ 13 BGB).§2 Conclusion of a contract, storage of the contract text
(1) The following regulations regarding the conclusion of the contract apply to orders via our online shop https://www.hookahx.de. (2) If the contract is concluded, the contract comes with it HookahX.de Martin Vergin Schlesische Straße 59 D-40231 Düsseldorf accomplished. (3) The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract. The offer is accepted in writing, in text form or by sending the ordered goods within one week. If the deadline has expired without result, the offer is considered rejected. (4) When an order is received in our online shop, the following regulations apply: The consumer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop. The order takes place in the following steps:- Selection of the desired goods
- Confirm by clicking on the “Show shopping cart” or “View cart” buttons.
- Checking the information in the shopping cart
- Pressing the “Continue to pay” button
- Optional registration in the online shop after registration and entering the registration details (email address and password).
- Re-checking or correcting the respective data entered.
- Binding dispatch of the order by clicking the “Buy now” or “Pay” button.
§3 Prices, shipping costs, payment, due date
(1) The prices stated include statutory VAT and other price components. Shipping costs, if any, are added. (2) The consumer can pay by advance payment, PayPal, credit card (Visa, Mastercard, American Express), Klarna, Apple Pay or Google Pay. (3) If the consumer has chosen advance payment, the consumer undertakes to pay the purchase price immediately after conclusion of the contract.§4 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for immediate dispatch. Delivery takes place within 5 working days at the latest. In the case of payment in advance, the deadline for delivery begins on the day after the payment order is sent to the bank responsible for the transfer and, for all other payment methods, on the day after the contract is concluded. If the deadline falls on a Saturday, Sunday or public holiday at the delivery location, the deadline ends on the next working day. (2) The risk of accidental loss and accidental deterioration of the item sold, even in the case of a mail order purchase, only passes to the buyer when the item is handed over to the buyer.§4a Youth protection and age verification
(1) The sale and shipping of tobacco products, tobacco-containing products, nicotine-containing products as well as e-cigarettes, e-shishas and their accessories takes place exclusively to people who have reached the age of 18. The provisions of the Youth Protection Act (JuSchG) apply, in particular Section 10 JuSchG. (2) During the ordering process, the customer confirms that they are of legal age. We reserve the right not to carry out orders where there is concrete evidence that the purchaser or the actual recipient is underage. (3) Age-restricted goods are delivered exclusively via DHL using the service “Age check from 18” (identification check). The goods will only be handed over personally to the adult purchaser or an adult who is authorized to receive them. The delivery person checks the age using a valid official photo ID (ID card, passport or driving license). In this case, it is not possible to store it in the parcel shop, with a neighbor or at a desired storage location. (4) If the age verification cannot be carried out successfully upon delivery (e.g. recipient is not of legal age, has not been found or does not have a valid identification document), the shipment will be returned to us. The resulting costs for return and re-shipment may be charged to the customer.§5 Retention of title
We reserve ownership of the goods until the purchase price has been paid in full.§6 Right of withdrawal of the customer as a consumer

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (Martin Vergin, HookahX.de, Schlesische Straße 59, D-40231 Düsseldorf, phone: +49 1515 3766610, email: support@hookahx.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the model withdrawal form in § 7 of our terms and conditions (available at https://hookahx.de/agb/) for this purpose, but it is not mandatory.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which the notice of your withdrawal from this contract was received by us. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will bear the direct cost of returning the goods.
Early expiry of the right of withdrawal (health protection and hygiene)
The right of withdrawal expires early in the case of contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if their seal has been removed after delivery (Section 312g (2) No. 3 of the German Civil Code, BGB). For us, this applies in particular to the following goods, in each case if their seal has been removed after delivery:
- tobacco in opened packaging (seal or film removed);
- heads (hookah bowls);
- XKAH devices or other electric smokeboxes and HMDs (e.g. XKAH Pro);
- shisha bases (vases/glasses);
- shishas.
Inspection of the goods and compensation for use
Your right of withdrawal remains in place even if you have unpacked the goods to inspect them; this does not affect the early expiry of the right of withdrawal for sealed goods after the seal has been removed, as set out above. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. We ask you to return the goods in their original packaging if possible; however, this is not a condition for the effective exercise of the right of withdrawal.
If you use goods beyond such an inspection, for example by smoking with them, you must compensate us for the resulting loss in value, up to the full purchase price. This applies in particular to used shishas as well as to used heads, shisha bases and XKAH devices or other electric smokeboxes and HMDs for which the right of withdrawal has not already expired because the seal was removed. For hygiene reasons, we are generally unable to resell used goods. Our principle is therefore: whatever has been used is not taken back as new goods; we offset the loss in value against the refund.
Financed transactions
If you have financed this contract with a loan and you withdraw from the financed contract, you are no longer bound by the loan agreement either, provided that both contracts form an economic unit. This is to be assumed in particular if we are also your lender or if your lender makes use of our cooperation with regard to the financing. If the loan has already been paid to us when the withdrawal or return takes effect, your lender assumes our rights and obligations under the financed contract in relation to you with regard to the legal consequences of the withdrawal or return. The latter does not apply if the subject of this contract is the acquisition of securities, foreign currencies, derivatives or precious metals. If you wish to avoid being contractually bound as far as possible, withdraw from both contractual declarations separately.
